Terms of Service

These Terms and Conditions (“Terms” or “Agreement”) govern your use of the software owned and operated by Echo Trader LLC (“we,” “our,” “us”, "Echo Trader"). This includes the Echo Trader website, application, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform. These Terms are between you ("User") and Echo Trader LLC.

1. Eligibility

You must be at least 18 years of age to use the Platform. You are solely responsible for ensuring compliance with applicable laws and regulations in your jurisdiction.

2. Grant to Use the Echo Trader Software

Subject to your compliance with these Terms, Echo Trader grants you a limited, non-exclusive, non-transferable right to use the Echo Trader software platform (the “Platform”) solely for your personal or business trading purposes.

i. Single User License: Your subscription is licensed to you as a single user. You may connect and trade only brokerage or funded accounts that you own or that you are otherwise authorized to trade, including accounts held by a business entity you control, accounts you hold jointly, and prop firm or funded evaluation accounts issued to you. You may not share your Platform credentials with, or provide Platform access to, any other person.

ii. Trading Third-Party Capital: You may not use the Platform to place, copy, or manage trades in accounts belonging to third parties for compensation, or as part of a service offered to others, without Echo Trader’s prior written consent or a separate commercial agreement with Echo Trader. If you wish to use the Platform to trade capital on behalf of others, contact support@echotrader.io to discuss appropriate licensing. Nothing in this section relieves you of your obligations under Section 1, including your responsibility to hold any registration or license that applicable law requires in order to trade or manage assets for others.

3. Use of the Platform

You agree only to use the Platform as instructed with no negative intent.

You agree not to:

  • Reverse-engineer, decompile, or attempt to derive the source code of the Platform;
  • Use the Platform for unlawful purposes;
  • Resell, sublicense, or transfer access without prior written consent, or use the Platform outside the scope of the license granted in Section 2;
  • Harm the Platform in any way.

Echo Trader is only looking to work with users who want to learn, grow, and interact with the software in a positive light. Echo Trader reserves the right to terminate User’s membership if User knowingly spreads false information or degrades the reputation of Echo Trader.

4. No Financial Advice

The Platform is provided for your use only. The Platform may inform you what high performing traders are doing to be successful, but it is solely your decision to act on this information. Echo Trader do not provide investment, legal, or financial advice. All trading decisions are made solely by you and at your own risk. Echo Trader is not a broker, dealer, investment advisor, or fiduciary.

5. Disclaimers

i. Risk and Acknowledgement: Trading securities, futures, and derivatives involves substantial risk of loss and is not suitable for every investor. Automated trading may increase risk exposure. Past performance is not indicative of future results. By using the Platform, you acknowledge and accept these risks. You assume all risk when using the Platform. Echo Trader is not liable for any losses, monetary or otherwise. There is no guarantee to prevent losses or to make profits by using the Platform. Additionally, the Platform involves the use of electronic transmission of data and information across wireless and other networks. You acknowledge and agree that Echo Trader does not operate or control such networks and is not responsible or liable for the privacy and security of your data or information. You agree that it is solely your responsibility to secure and protect the networks you use. You must also safeguard and protect your login credentials and any other sensitive information. Echo Trader takes no responsibility for your actions, connections, trade settings, or any settings or configuration in the Platform. You remain fully responsible for any trades, trade settings, turning trading on and off, connections, and similar settings available in the Platform. Additionally, Echo Trader is not responsible in the event of a data breach or hack of the Platform. If such an unforeseen event occurs, you must take the necessary steps to protect your information. Echo Trader does not store your access information, but you still must take necessary measures to protect your information. You bear the full risk and responsibility of the factors described in this agreement.

ii. Rules: You are not required to use a prop firm but if one is being utilized, you are responsible for abiding by the prop firm’s rules and regulations, including any rules governing copy trading, account sharing, and simultaneous trading across multiple accounts. You are responsible for monitoring trades in your brokerage and must edit or cancel trades manually if needed setting appropriate loss limits to protect assets. Echo Trader is not responsible for outages or technical issues of the brokerage or other third party software.

iii. Availability: Echo Trader does not guarantee uptime of the Platform and may perform planned or unplanned maintenance or upgrade activities that impact the availability of the Platform. Echo Trader is providing the Platform “as is” and “as available” without warranties of any kind.

6. Subscriptions

Echo Trader is a subscription based Platform and users must either use a free trial or purchase a subscription to use the Platform.

i. Free Trial: Echo Trader may offer new users a free trial of the Platform for a period of seven (7) days (“Free Trial”). During the Free Trial, you may access the Platform without charge, subject to these Terms. At the end of the Free Trial, unless you cancel before the trial period expires, your account will automatically convert to a paid subscription, and you authorize Echo Trader to charge your selected payment method.

ii. Subscription Plans: We offer subscription options on a monthly or yearly basis (each, a “Subscription”). By purchasing a Subscription, you agree to pay the applicable fees for the selected plan. Subscription fees are billed in advance and are non-refundable, except as expressly provided in these Terms or as required by law. User can cancel, upgrade, or downgrade their Subscription at any time.

Monthly Subscription: The monthly Subscription is billed on a recurring monthly basis, starting on the date you purchase the Subscription (or the day your Free Trial ends).

Yearly Subscription: The yearly Subscription is billed on a recurring annual basis, starting on the date you purchase the Subscription (or the day your Free Trial ends).

iv. Changes to Pricing: Echo Trader may change its subscription fees from time to time. Any changes to fees will take effect at the start of the next billing cycle following notice to you, provided that you will have an opportunity to cancel your Subscription before such changes take effect.

v. No Refunds: All subscription fees are prepaid and non-refundable. If you cancel your Subscription in the middle of a billing cycle, you will continue to have access to the Service until the end of your current billing period, but you will not receive a refund or credit for any unused portion of the Subscription.

vi. Billing: User is required to provide accurate and up-to-date billing information. If automatic billing fails for any reason, Echo Trader may suspend or terminate your Subscription at our sole discretion.

7. Data & Privacy

Your use of the Platform is governed by our Privacy Policy.

By using the Platform, you agree that Echo Trader may collect, analyze, and use data related to your trading activity, account performance, and use of the Platform (“Trading Data”). Echo Trader may use Trading Data (in aggregated or anonymized form where possible) to improve the Platform, develop insights, and provide features designed to help users improve their trading performance. You further acknowledge and agree that Echo Trader may use Trading Data in aggregated or anonymized form for marketing, advertising, and promotional purposes, including, without limitation, in posts, advertisements, case studies, and other content distributed on social media platforms (such as Instagram, X, TikTok, YouTube, Facebook, and LinkedIn), on the Echo Trader website, in email campaigns, and in other marketing channels. Such marketing content will not include your name, email address, account numbers, or other direct identifiers, and Echo Trader will use commercially reasonable efforts to prevent re-identification. You acknowledge and agree that Echo Trader may, in its sole discretion, use information derived from Trading Data to inform or execute trading strategies in accounts owned or controlled by Echo Trader. Echo Trader is under no obligation to disclose such trading activity to you, and you agree that Echo Trader does not owe you any fiduciary duty or obligation in connection with its use of Trading Data for its own trading purposes.

You grant Echo Trader a non-exclusive, royalty-free, worldwide license to quote, screenshot, reproduce, and share content you publicly post about Echo Trader — whether in Echo Trader community channels (such as our Discord server or in-app community features), on social media platforms (such as Instagram, X, TikTok, YouTube, Facebook, LinkedIn), or in third-party communities (such as Skool, Reddit, and trading forums) — for marketing, promotional, and educational purposes. When Echo Trader uses such content, it may attribute it to the handle, username, or display name you used to post it. Echo Trader will not use such content in a manner that materially misrepresents your views or implies an endorsement you have not given. If you request in writing that Echo Trader stop using specific content you have posted, Echo Trader will remove or discontinue such use within a commercially reasonable time, except where the content has already been published in materials that cannot be practically recalled.

8. Termination & Suspension

We may suspend or terminate your access to the Platform at our sole discretion if you violate these Terms or engage in unlawful or abusive behavior.

9. Intellectual Property

All trademarks, logos, algorithms, and other intellectual property related to the Platform belong exclusively to Echo Trader. You are granted no rights other than those expressly stated in these Terms.

10. Property Rights and Confidentiality

Echo Trader will maintain the confidentiality of your information in accordance with our [Privacy Policy]. You agree not to disclose any non-public information about the Platform, including our software, systems, and pricing, except as required by law. Echo Trader owns and maintains the Platform and is in no way giving User ownership of the software.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Echo Trader shall not be liable for any trading losses, lost profits, or indirect, incidental, or consequential damages.
  • Total liability shall not exceed the lesser of (i) fees paid in the preceding 12 months or (ii) $350.
  • You agree that Echo Trader shall have no liability to you arising out of your use of the Platform.

12. Indemnification

You agree to indemnify and hold harmless Echo Trader, including their affiliates, officers, and employees, from any claims, damages, or losses arising from your use of the Platform or violation of these Terms.

13. Governing Law & Dispute Resolution

In case of any dispute arising out of this Agreement, including any question regarding its interpretation, existence, validity, or termination, each party will use its best efforts to resolve the dispute by good faith negotiation within a period of Thirty (30) Business Days following notification of the dispute. Good faith negotiation requires that positions and offers be made and the articulated reasons for rejecting such positions or offers are provided. Should such good faith negotiations be unable to resolve all disputed issues, the parties will attempt to resolve any remaining dispute arising out of or relating to this by binding arbitration under the rules of the American Arbitration Association. The arbitrator shall award the costs of arbitration, including reasonable attorney fees, to the prevailing party. The arbitrator's award will be final, and judgment may be entered upon it by any court having proper jurisdiction. Arbitration shall be limited to a single (1) arbitrator. Any party who files a lawsuit in court without following the procedures stated herein shall be in breach of this provision of the Agreement and the non-filing party shall be awarded the cost of dismissing such action, including reasonable attorney fees. You waive any right to participate in class actions.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.

15. Miscellaneous

These Terms constitute the entire agreement between User and Echo Trader. If any provision is held invalid, the remainder shall remain in effect. Our failure to enforce any provision shall not constitute a waiver.
